The outcome can be a new decision on all or part of the points raised, or the previous decision may be upheld. | We have concluded that the unfilled gaps in the record, coupled with the problematic nature of some of the district court's fact findings, prevent proper appellate review of the merits of the important constitutional issue raised in this case. The Court found that the Tax Court's practice of not disclosing the special trial judge's original report and of obscuring the Tax Court judge's mode of reviewing that report, impedes a fully informed appellate review of the Tax Court decision. Instead, it either accrued in 2001 when it was paid or will accrue when the appellate review concludes. |
