A recent example is the class action brought by the ACCC alleging misleading and deceptive conduct against Allphones Retail Pty Ltd (and current and former directors and executives of that company) on behalf of certain current and former franchisees. A judge preemptively nixed a class action against Wal-Mart and dog food manufacturer Menu Foods, among others, ruling that the need for individual factual inquiries made a class action untenable. A study released in January shows that class action and collective action lawsuits are on the rise, and the trend is expected to continue. |
