Declaration of Rights

In Britain, the statement issued by the Convention Parliament in February 1689, laying down the conditions under which the crown was to be offered to William III and Mary. Its clauses were later incorporated in the Bill of Rights.

In a 1789 letter to James Madison on the subject of including a bill of rights in the new Constitution, Jefferson wrote, "In the arguments in favor of a declaration of rights, you omit one which has great weight with me, the legal check which it puts into the hands of the judiciary.
These modern laws provide only the formal declaration of rights, which leaves out the cultural systems and practices that continue undisturbed.
This requirement was incorporated into the Virginia Declaration of Rights, which in turn became the basis for the famous Declaration of Independence.
