The Eleventh Amendment is the key constitutional text in Thomas's argument. The district court summarily dismissed the suit, finding that the suit was barred by the Eleventh Amendment and that the plaintiff's Fourteenth Amendment rights were not violated. Florida, 517 US 44 (1996), in which the Supreme Court held that the Eleventh Amendment to the Constitution precluded states from being the subject of lawsuits in a Federal court, unless the state's laws waived immunity. |
