Herndon v. Lowry

US Supreme Court decision of 1937 dealing with state restriction of First Amendment rights in sedition cases. Herndon, a communist organizer convicted of sedition under a Georgia law, appealed to the US Supreme Court for protection of his right to free speech. The Court reversed Herndon's conviction, ruling that a tendency to incite violent revolt was not sufficient grounds to revoke First Amendment rights without evidence of a ‘clear and present danger’ to society.
