Immigration and Naturalization Service v. Chadha

US Supreme Court decision of 1983 dealing with the power of Congress to overrule decisions of the executive branch regarding immigration. Chadha, a foreign student allowed by the Immigration and Naturalization Service (INS) to remain in the country after the expiration of his visa, was deported by the House of Representatives. By the Immigration and Nationality Act, this veto of an INS ruling was within the power of either house of Congress, but Chadha appealed, challenging the constitutionality of the act. The Court ruled to invalidate the provision of the act that allowed a single house to veto INS rulings, judging one-house vetoes to be unconstitutional under any circumstance.
