Near v. Minnesota

US Supreme Court decision of 1931 dealing with restrictions on the free press imposed by state libel laws. The Court overruled the actions of Minnesota officials who shut down Near's newspaper because it criticized law enforcement in the state. The Court found the Minnesota statute prohibiting scandalous publications unconstitutional because it allowed the state to suppress material before it was written rather than prosecuting authors of scandalous material after publication.
