Prigg v. Pennsylvania

US Supreme Court decision of 1842 dealing with state and federal legislation about the removal of escaped slaves from ‘free’ states. When Prigg, sent to recapture an escaped Maryland slave, was arrested for kidnapping under a Pennsylvania ‘personal liberty’ law that prevented forcible seizure and removal of former slaves, he sued Pennsylvania in the US Supreme Court. The Court ruled the Pennsylvania law unconstitutional, upholding the federal Fugitive Slave Act and granting Congress absolute power over legislation about fugitive slaves. Many Northern states responded by passing laws that prohibited state officials from cooperating with the federal removal of runaways.
