Schenck v. US

Schenck v. US

US Supreme Court decision of 1919 dealing with Congress's power to revoke First Amendment rights. Schenck, an outspoken antidraft activist, was convicted of providing aid and comfort to the enemy, in violation of the Espionage Act 1917. The Court unanimously upheld his conviction, ruling that Congress was obligated to interfere with the freedom of speech when it presented a ‘clear and present danger’ to the well-being of the society.
