Whitney v. California

Whitney v. California

US Supreme Court decision of 1927 dealing with state legislation restricting freedom of speech and assembly. Charlotte Whitney had been convicted, under a California law outlawing membership in organizations advocating political or industrial violence, for her activities in the Communist Labor Party. She appealed to the Supreme Court for protection under the First Amendment. The Court upheld the California law, ruling that states were obligated to thwart ‘all threats to the American form of government, no matter how remote.’
